$500,000 for NJ kids forced to eat on gym floor

Seven students forced to eat lunch on their New Jersey school's gymnasium floor for two weeks as punishment won a $500,000 legal settlement, their attorney said Tuesday.

The 2008 incident involved fifth-grade students at Charles Sumner Elementary School in Camden, N.J., who were disciplined after one child spilled water as he tried to lift a jug onto a cooler, according to lawyer Alan Schorr.


The students filed a federal lawsuit against the Camden Board of Education, which agreed to the settlement, Schorr said.

He said the incident took place against a backdrop of discord between the black and Hispanic populations in the impoverished southern New Jersey city. The children were Hispanic.

Schorr said the vice principal, who was African-American, punished all 15 students in a bilingual class by making them eat off paper liners normally used on lunch trays. (While there were 15 students in the class, only seven sued.)

"The African-American kids were eating at tables, with trays, taunting these Hispanic kids who were forced to eat on the ground," Schorr said.

The vice principal has since transferred.

CourierPostOnline.com reported that the board of education had approved the settlement but not admitted any guilt.

It added:

"Under the settlement, the students will split $280,000, which works out to $31,428 each. Their attorney, Alan H. Schorr of Cherry Hill, will get $220,000."

The children's teacher was fired after encouraging them to tell their parents about the punishment. The teacher won a $75,000 settlement earlier.

Neither school officials nor their lawyers could be reached for comment.

Front entry doors: Curb appeal is the first step in a successful home sale, and installing a beautiful, high-quality entry door is a simple home improvement that delivers impact both in buyer drive-bys and online listings. A new entry door will also help lower home energy costs and stand up to weather extremes.

Business Continuity and Risk Management: Essentials of Organizational Resilience

I recently had the pleasure of reviewing a textbook which is a state-of-the-art summation of the current global body of knowledge for Business Continuity Management (BCM), including current international standards and best practices. The book is designed to be used as part of a college-level course or as a desk reference guide, or resource for your in-house team.

The book is written in a traditional modular design which allows the reader to explore each chapter as a stand-alone unit, and then follow the after-chapter Q&A and case study questions. The first ten chapters cover the fundamental principles and practices of business continuity, and give the reader a good command of the terminology and definitions. (A constant source of debate in our profession.) The authors blend the how?s and the why?s along with the industry standards and recommended best practices to offer a solid functional background to the reader.

Three chapters delve into greater detail on Information Technology / Disaster Recovery and Emergency Management. Many in-house programs choose to segment these functional areas into totally separate business units and departments within the organization. Therefore this book allows the reader to understand the inter-relationships between business continuity ? risk management ? emergency management ? disaster recovery, but then follow the standards and corporate culture which are in-place within their own organization. Since this book was written in 2011, the reader will find an excellent chapter on the importance of crisis communications including the role of social media in their communications plans.

The final four chapters detail the role of enterprise risk management for those readers who wish a stronger foundation in statistical modeling, and how to conduct and score a risk assessment (also known as a Hazards & Vulnerabilities Assessment).

The authors present case studies for two different organizations (an investment services firm and a widget manufacturing company), and then integrates those case studies throughout the text to demonstrate how the material would be used in a real world setting. The end-of-chapter questions ask the user to put themselves into the role of a contingency planner for one of the two organizations, and then apply what was learned in the previous section. That?s a nice touch which gives the reader the preferred blend of academic knowledge and functional experience.

Both The Business Continuity Institute (BCI) and the Institute of Risk Management (IRM) have endorsed the book, and it makes a terrific study guide for their certification programs.

A great book for educators, students, and practitioners. The material is fresh, topical, and presented in an easy-to-read and understand format. Add this one to your personal library!

Tunisia's new constitution 'not ready' before April 2013

Tunisia's new constitution will not be adopted by parliament until April 2013, six months later than planned, Habib Khedher, who heads the committee in charge of drafting the constitution, said on Monday.

"The final draft of the constitution could be put to the vote (in the National Constituent Assembly) at the end of April," said the lawyer, who belongs to the ruling Islamist party Ennahda and is an elected member of the interim parliament.

"I think that is a realistic target," Kheder told AFP.

The government had until now insisted that it would meet the deadline of October 23 for ratifying the new constitution, in order to hold planned general elections in March 2013.

The delay risks aggravating the political uncertainties facing Tunisia, which has been rocked by social unrest in recent months linked to poor living conditions and fears that a rising Islamist tide threatens personal freedoms.

The new timetable will be discussed at a meeting of the NCA on September 3, ahead of the next parliamentary session, Kheder said.

Tunisia's main parties were given one year to draft a new constitution, after elections that brought Ennahda to power at the head of a coalition also grouping centre-left parties the Congress for the Republic and Ettakatol.

It will replace the provisional laws that have governed Tunisia since the revolution that overthrew veteran strongman Zine El Abidine Ben Ali in January 2011, and allow fresh elections to take place.

But the project has been heavily delayed due to an apparent deadlock over certain key issues, with the Islamists seeking a pure parliamentary system and the other parties wanting important powers to remain in the hands of the president.

The first version was due to have been presented at the end of last month, but was never completed, and a final draft should have been ready by October, Kheder explained.

There are six committees responsible for the six different chapters of the constitution, with each article to be submitted individually for approval by MPs, who can make further amendments.

Only then can the text be adopted by parliament, where it requires a two-thirds majority.

In the absence of compromise, the draft constitution will be put to a referendum.

WikiLeaks site attack continues into 10th day

Controversial document-sharing?website WikiLeaks remained down Monday, as a massive?Distributed Denial of Service (DDoS) attack continued. ?An individual or group identifying itself as "Anti?Leaks" takes?credit for the outage, which has also knocked out many?WikiLeaks mirror sites.

Hacker group Anonymous, behind many of the DDoS attacks on government websites in the past, including the CIA, and which posted the hacked?emails of law enforcement officials, said on one of its blogs:

We are now witnessing cyber wars, with most Wikileaks sites under sustained DDoS attack over several days. On one side are Wikileaks itself and it?s hactivist?(sic)?supporters, such as Anonymous. On the other side are US Govt supporters.

Anonymous, a strong supporter of WikiLeaks,?provided "two ways" to access WikiLeaks information, one using Tor, an anonymous network;?the other using a variety of mirror sites that have been set up but not yet attacked by AntiLeaks.

Among the sites is one called "Global Files," which features files?some?security experts speculate is the main reason behind the current?WikiLeaks attacks.??

The files are documents from intelligence firm Stratfor,?which deal with a secret surveillance system in the U.S.?called TrapWire. As?Carole Theriault of Sophos Security wrote Monday, the WikiLeaks attacks happened after the group published "the latest of its Global Intelligence Files (GIF), discussing the implementation of TrapWire in public spaces in the US."

Meanwhile, AntiLeaks said Monday in a posting?that Internet chatter that the group is U.S.-government backed?is not true:

"We find the speculation that we are not behind these attacks and/or that we are CIA/NSA/FBI or even wikileaks themselves to be downright comical."
